Orders & Payments
- On placement of order, payment is requested in full for the tree(s)/shrub(s). This includes a 25% non-refundable deposit.
- If delivery is required, this will be invoiced and payment will be due by return.
- If the order, or any part of it is cancelled the deposit for that order will be lost, but the remaining balance including delivery charge will be refunded.
- Orders placed by telephone will be confirmed in writing detailing the specimen/s, payment details, delivery address and time frame.
Deliveries
- We calculate delivery charges by the mile. Our standard rate is £2.16 per mile (inclusive VAT). We only charge for the single, one-way trip and not a return trip. We use Google Maps to calculate the mileage from BB7 3NA to the postcode of the delivery address, and you will receive an invoice for the total value of your order including delivery.
- We will confirm prior the to delivery the date and approximate time of delivery.
- We reserve the right to delay despatch of the plants if weather conditions are unsuitable for lifting and despatch.
- The purchaser must be available to accept delivery, check the order and confirm that the trees have been delivered in excellent condition. We will only accept liability for missing or damaged trees in the event that we are at fault.
- If required, parking permits and/or adequate parking space for the delivery vehicle must be arranged and paid for by the client prior to delivery. If this is not done and parking tickets occur outside of our control, the cost will be passed on to the client. Additionally, if there is nowhere to park and the delivery has to be abandoned due to no fault of our own there will be a redelivery charge. Furthermore, if we are unable to park close to the delivery site resulting in significant increase in the amount of labour required to offload, we reserve the right to notify you of the additional cost you will incur.
- Our driver has the right to reasonably refuse to offload if he deems conditions to be unsafe or if conditions are such that the delivery vehicle may get stuck.
- If our truck is stopped from unloading and standing time results, a £40 per hour fee will be charged. Having to return the trees to our nursery and redeliver them later will result in an additional labour charge and redelivery fee, unless the error was caused by Clough Bottom Trees & Shrubs or any member of our team.
Collections
- If you are planning on collecting your own trees from our site in Bashall Eaves, we will require at least 24 hours' notice to prepare orders. Please ensure that your vehicle is long enough and has ample cover to protect the stock during transit.
Planting
- Clients are responsible for the preparation of the site, digging and planting to current British Standards. Please refer to the Planting Tips page for specific details.
General Terms
- These terms and conditions shall take precedence over any others that customers may attach to their orders.
- Prices are quoted for the plant stock only and do not include delivery. VAT is included in all tree prices and in delivery charges. Our VAT reg. number is 572 357527.
- Although every effort is made to maintain prices shown on our availability list for the entire season, Clough Bottom Trees & Shrubs reserves the right to modify prices without advance notice.
- We hereby reserve the right to the property of any goods sold until payment in full has cleared.
- All plants are believed to be true to name, but in the event of an error on our part, our liability to pay charges or compensate shall not exceed a refund of the price paid.
Warranty
- Clough Bottom Trees & Shrubs guarantee that the stock is supplied structurally sound, has a good root system, is in good health and true to type. It is the customer's responsibility to check the stock on arrival. We will investigate any complaints in good faith, and replace/refund in cases where legitimate problems are found.
- Clough Bottom Trees & Shrubs cannot be held responsible for losses beyond our control. We shall be under no liability in respect of any defect arising from adverse weather conditions, fair wear and tear, wilful damage, negligence of ther buyer or his employees, abnormal working conditions, poor storage, poor husbandry, poor or unsuitable soil conditions, failure to follow our instructions (written or verbal), misuse or mistreatment of the plants.
- If the tree(s) should fail and it is agreed that Clough Bottom Trees & Shrubs is responsible for its replacement, we agree to do our utmost to replace the tree(s) with the same type and size as originally ordered. However, in certain circumstances, exact replacements may not be possible, in which case you will be notified and an agreement made regarding an alternative choice.
- Clough Bottom Trees & Shrubs will not be held responsible for any tree failures where the planting is not compliant to current British Standards.
- No returns are possible once the sale has been completed by the exchange of invoice and payment. Any complaint that the plants delivered are not of the correct quality or quantity or have been damaged during delivery should be notified to Clough Bottom Trees & Shrubs within 24 hours of delivery. The buyer may be requested to submit this claim in writing too. All other claims, including consequential loss, are excluded. In no circumstances shall the liability of Clough Bottom Trees & Shrubs be greater than the value of the trees/shrubs concerned (as shown on the price list).
